1. Validity of the General Terms and Conditions and Conclusion of Contract

1.1. These general terms and conditions (GTC) apply to purchase contracts concluded between Walter Möbel* and private and business customers. Unless otherwise stated, the GTC apply equally to purchases of goods and services in the sales branch and in the field, as well as in distance sales concluded via the online shop, telephone, email or letter.

1.2. These General Terms and Conditions also apply to purchase contracts for goods that are concluded in special sales or warehouse sales. In such transactions, however, the buyer is not entitled to the following provisions:

- Right of withdrawal and exchange (Section 4), this does not apply
- Warranty for defects and guarantee (Section 4), this does not apply
- Methods of payment (Section 5). The goods must be paid for immediately and on site.

1.3. In distance selling, the customer can freely choose whether he wants to place an order with or without registration. The customer undertakes to always provide truthful information.

2. Prices, special offers and delivery rates

2.1. Prices include VAT and are quoted in CHF. Transport and assembly costs are listed and charged separately.

2.2. Deliveries to car-free and heavily trafficked streets and locations must be agreed and calculated individually. The buyer undertakes to provide truthful information about the difficult access situation. Parcels are usually delivered by post to the first front door. Large and bulky furniture is delivered to the curb unless otherwise agreed.

2.3. If the costs for shipping abroad for furniture weighing more than 30 kg exceed the costs stated in the online shop, Walter Möbel* reserves the right to pass on the additional costs to the buyer. In return, the buyer may withdraw from the purchase contract if he does not agree to the additional costs incurred.

2.4. The prices confirmed at the time of ordering apply to customers. Walter Möbel* reserves the right to adjust prices and make pricing errors at any time.

3. delivery and collection conditions

3.1. All dimensions, weights, information and illustrations of our products are non-binding. Descriptions and technical information can be adjusted at any time.

3.2. If the goods are in stock in the online shop, they are considered to be immediately available and delivery is usually made within three to five working days, provided that the ordered quantity does not exceed the stock level.

3.3. For purchases in the sales branch, different delivery conditions apply than for distance selling. The organization of the delivery of the purchased goods in the sales branch is the responsibility of the buyer.

3.4. If delivery is not possible via the stairs or lift and a special delivery is therefore necessary, the responsibility for further transport of the goods lies with the buyer.

3.5. When purchasing multiple items, delivery or shipping will be made as soon as all products are ready for delivery. Shipping will only take place once the sales price has been paid in full.

3.6. If collection was agreed with the buyer when the sale was placed, the buyer will be informed as soon as the goods have arrived at the agreed location. If the buyer fails to collect the goods despite a warning or refuses to deliver or accept the goods, Walter Möbel* is entitled to charge rent for interim storage one month after the goods arrive. The rent is 5% of the purchase price for each additional month or part thereof.

3.7. Collection of goods purchased in the online shop is possible by arrangement.

4. transition of benefit and danger

4.1. The transfer of benefit and risk of new goods takes place

- after their elimination or picking (pick-up goods)
- after handover for delivery or shipping (delivery and postal shipping)
- when handing over to the customer (direct sale from the warehouse with immediate collection)

5. Guarantee, liability, right of withdrawal and cancellation

5.1. There is a 24-month guarantee against design and material defects from the delivery date. If the manufacturer's warranty includes a longer period, the latter applies.

5.2. Deviations in structure and color are unavoidable for certain materials (wood, marble, leather, textiles, etc.) compared to the specifications and therefore do not constitute grounds for complaints or warranty claims. In normal cases, no guarantee can be given for the lightfastness of the colors of wood, leather, plastic and certain textile fabrics.

5.3. For online purchases, the customer can withdraw from the purchase contract within 14 days. Any payments already made will be refunded by Walter Möbel*.

5.4 In the case of purchases made in the store, the customer cannot withdraw from the purchase contract and is not entitled to a refund.

5.5. Excluded from the right of withdrawal and return are custom-made items, individual pieces and orders that are not in stock and had to be explicitly ordered for the customer.

5.6 When purchasing a carpet, there is a right to exchange it.

5.7. Delayed deliveries do not entitle the buyer to withdraw from the contract or to make claims for damages of any kind. If a longer delivery period is necessary or if this changes, the customer will be informed in good time by Walter Möbel*.

5.8. All returns, whether in person or by post, must be announced using a return form on the day of dispatch. The goods must be returned in their original packaging, and in the case of unpackaged goods, in perfect and unused condition, at your own expense. Payments already made will be refunded. Damaged or incorrectly delivered goods must be reported immediately after receipt of the goods and the corresponding claims must be made.

5.9. The guarantee does not cover damage caused by incorrect operation or unprofessional interventions or by wear, aging and improper handling. The guarantee expires if goods have been further processed or modified by the buyer despite obvious defects. Walter Möbel* accepts no liability for damage caused to the building structure (e.g. floor, walls) or to the buyer's furniture through use of the goods. The buyer must ensure before use that the product cannot cause any damage. Furthermore, Walter Möbel* is not liable for damage to supplied furniture and materials caused in connection with a room climate that is too humid or too dry** or direct sunlight.

5.10. If the buyer claims justified defects, Walter Möbel* has the choice of remedying the defects within a reasonable time by means of a professional, free repair or replacing the goods with a new one. The buyer can only withdraw from the purchase contract if Walter Möbel* is unable to remedy the defects.

5.11. Walter Möbel* is not obliged to accept orders if the customer has outstanding payments from previous purchases or if his account is subject to debt collection measures. If the customer's outstanding payments are only discovered after the purchase contract has been concluded, Walter Möbel* has the right to withdraw from the contract at any time and without any compensation and to invoice for deliveries and services already provided.

6. payment

6.1. In principle, all purchases are made against advance payment. In addition to cash payments, the sales branch also accepts payments by debit card (Postcard, Maestro), credit card (Mastercard, Visa), Twint or invoice. If no different payment period has been agreed for invoices, a payment period of ten days net applies.

6.2. For online sales, Walter Möbel* accepts payments via PayPal, Sofort Überweisung, advance payment by bank transfer, credit cards (Mastercard, Visa) and Twint.

6.3. If the agreed payment deadline is not met, the customer will be in default without further notice. Walter Möbel* reserves the right to initiate legal enforcement measures after a written reminder and to reclaim the costs incurred as a result of the default for reminders and enforcement, including 5% default interest.

6.4 The goods remain the property of the Seller until the purchase price has been paid in full.

7. Liability for online connections

7.1. In their own interest, customers should keep passwords and user names secret from third parties. Walter Möbel* excludes all liability for misuse or negligent use.

7.2. Walter Möbel* shall not be liable for defects and disruptions for which it is not responsible or which have arisen due to force majeure or unlawful intervention by third parties, in particular not for safety defects and operational failures of third-party companies with which it cooperates or on which it is dependent.

     8. Application of law and place of jurisdiction

8.1.  These General Terms and Conditions are governed by Swiss law, in particular the provisions of the Swiss Code of Obligations.

8.2.  The place of jurisdiction is the statutory seat of Diff AG (Zurich).
